1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with Vailin Limited, operating under the brand Veinova (hereinafter "Seller"), regarding the goods displayed by the Seller in its online shop.
Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity.

1.2 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.


2) Conclusion of Contract

2.1 The product descriptions displayed in the online shop do not constitute binding offers but serve for the submission of a binding offer by the customer.

2.2 The customer submits a binding offer via the order form integrated into the online shop by placing the selected goods in the shopping cart and completing the ordering process.

2.3 The seller can accept the offer within five days:

  • by order confirmation via email
  • by delivery of the goods
  • by requesting payment

The contract is concluded at the time when one of the aforementioned alternatives occurs first.

2.4 The contract text is stored by the seller and sent to the customer by email after the order.

2.5 Before completing the order, the customer can correct input errors at any time.

2.6 Order processing usually takes place by email.

The customer must ensure that the email address provided is correct and that emails can be received.


3) Right of Withdrawal

3.1 Consumers generally have a statutory right of withdrawal of 14 days.

3.2 Further information on the right of withdrawal can be found in the seller's cancellation policy.


4) Prices and Payment Terms

4.1 All prices are total prices including statutory sales tax, if applicable. Shipping costs are stated separately.

4.2 For deliveries to countries outside the European Union, additional costs may arise (e.g., customs duties, taxes or bank charges) which are to be borne by the customer.

4.3 The following payment methods are offered in the online shop:

Payment via Shopify Payments (provided by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland).

The available payment methods are displayed to the customer during the order process.

5) Delivery and Shipping Conditions

5.1 Delivery is worldwide to the delivery address specified by the customer.

Processing time is usually 1–3 business days.
Delivery time averages 9–15 business days.

5.2 Shipping costs are:

€5.90 per order
free shipping from €100

5.3 If delivery fails for reasons for which the customer is responsible (e.g., incorrect address), the customer may be charged additional shipping costs.

5.4 If a product is unavailable, the customer will be informed and payments already made will be refunded.

5.5 Self-collection is not possible.


6) Retention of Title

The goods remain the property of the seller until full payment.


7) Liability for Defects (Warranty)

The statutory warranty rights apply.

For entrepreneurs, the following deviations apply:

  • Limitation period for new goods: 1 year
  • for used goods, warranty may be excluded

These restrictions do not apply in cases of:

  • intent or gross negligence
  • injury to life, body or health
  • Product Liability Act

8) Liability

The seller is fully liable for:

  • intent or gross negligence
  • injury to life, body or health
  • product liability

In the event of slight negligence in violating essential contractual obligations, liability is limited to foreseeable damages.

Otherwise, liability is excluded.


9) Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies insofar as it does not restrict mandatory consumer protection rights of the country of residence.


10) Alternative Dispute Resolution

The seller is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
